Terms of Service

1. Acceptance of Terms

By accessing and using PropTrust ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

PropTrust reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Platform shall be subject to the Terms of Service.

2. Description of Service

PropTrust provides a platform that connects property seekers with verified estate surveyors and valuers registered with recognized regulatory bodies in Nigeria, including but not limited to the Nigerian Institution of Estate Surveyors and Valuers (NIESV) and the Estate Surveyors and Valuers Registration Board of Nigeria (ESVARBON).

The Platform allows verified estate surveyors to list properties for sale or lease, and enables property seekers to browse listings and contact surveyors directly.

3. User Accounts and Registration

3.1 Estate Surveyors

To list properties on PropTrust, you must be a registered and verified estate surveyor or valuer with a recognized regulatory body. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify PropTrust immediately of any unauthorized use of your account

3.2 Property Seekers

Property seekers may browse listings without registration. However, to access certain features, you may need to create an account and provide accurate information.

4. Verification Process

PropTrust verifies estate surveyors and valuers by confirming their registration with recognized regulatory bodies. By registering as an estate surveyor, you:

• Warrant that you are a legitimately registered estate surveyor or valuer
• Authorize PropTrust to verify your credentials with regulatory bodies
• Agree that false information will result in immediate account termination
• Understand that verification status may be revoked if regulatory status changes

5. Property Listings

5.1 Listing Requirements

Estate surveyors agree to:

• Provide accurate and truthful information about properties
• Upload genuine photographs and descriptions
• Update listings promptly when property status changes
• Remove listings for properties that are no longer available
• Not post duplicate listings of the same property

5.2 Prohibited Content

Listings must not contain:

• False, misleading, or fraudulent information
• Properties you do not have authorization to list
• Offensive, inappropriate, or illegal content
• Contact information intended to bypass the platform

6. Subscription and Payment

Estate surveyors must subscribe to a paid plan to list properties. Subscription terms include:

• Payments are non-refundable except as required by law
• Subscription fees may be changed with 30 days notice
• Subscriptions auto-renew unless cancelled before renewal date
• Listing limits are based on the selected subscription tier
• Unpaid subscriptions may result in listing deactivation

Property seekers have free access to browse and contact estate surveyors with no subscription required.

7. User Conduct

All users agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code, viruses, or malware
• Attempt to gain unauthorized access to the Platform
• Harass, abuse, or harm other users
• Use the Platform for fraudulent purposes
• Scrape, data mine, or extract data from the Platform

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by PropTrust and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Users retain ownership of content they upload but grant PropTrust a license to use, display, and distribute such content on the Platform.

9. Limitation of Liability

PropTrust acts as a platform connecting property seekers with verified estate surveyors. We do not:

• Guarantee the accuracy of property information
• Take responsibility for transactions between users and surveyors
• Warrant that the Platform will be uninterrupted or error-free
• Accept liability for actions of estate surveyors on the Platform

Users are responsible for their own due diligence and should verify all property information independently before making any commitments.

10. Indemnification

You agree to indemnify and hold PropTrust harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.

11. Termination

PropTrust reserves the right to terminate or suspend your account and access to the Platform immediately, without prior notice, for conduct that we believe:

• Violates these Terms of Service
• Is harmful to other users or PropTrust
• Exposes PropTrust to liability
• Involves fraudulent or illegal activity

12. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy. We collect, use, and protect your personal information in accordance with applicable Nigerian data protection laws.

13. Dispute Resolution

Any disputes arising from these Terms or use of the Platform shall be resolved through:

• Initial attempt at informal resolution
• Mediation if informal resolution fails
• Arbitration under Nigerian law if mediation is unsuccessful

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

15. Changes to Terms

PropTrust reserves the right to modify or replace these Terms at any time. We will provide notice of significant changes by posting a notice on the Platform or sending an email to registered users. Continued use of the Platform after changes constitutes acceptance of the new Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
